    US Supreme Court reviews Boulder climate case

    WASHINGTON, D.C. / RankWire.AI / – The U.S. Supreme Court heard arguments over a major climate lawsuit from Boulder, Colorado. The dispute centers on whether federal law blocks state claims tied to greenhouse gas emissions. ExxonMobil and Suncor Energy want the Court to stop the case from moving forward under Colorado law. The justices also examined whether the Court has jurisdiction to decide the dispute now. The hearing took place on October 5 as the Court opened its 2026 term.

    US Supreme Court reviews Boulder climate case
    Boulder climate lawsuit tests the reach of state claims under federal environmental law

    Boulder County and the City of Boulder filed the lawsuit in 2018. The local governments seek compensation for climate-related costs they link to fossil fuel use. Their complaint also accuses the defendants of misleading the public about climate risks. ExxonMobil and Suncor Energy reject those claims. The companies argue that states cannot impose liability for global emissions through state law. The case has not reached a trial on the underlying liability allegations.

    The Colorado Supreme Court ruled in May 2025 that federal law did not preempt Boulder’s claims. That ruling allowed the lawsuit to continue in state court. The U.S. Supreme Court agreed to review the dispute in February 2026. It also asked the parties to address whether federal law and Article III give it jurisdiction. The case appears on the docket as Suncor Energy (U.S.A.) Inc. v. County Commissioners of Boulder County, No. 25-170.

    Federal law drives the dispute

    Lawyers for the companies told the Court that federal law governs interstate pollution and global climate issues. They also pointed to the Clean Air Act and limits on applying one state’s law beyond its borders. The U.S. government supported the petitioners as a friend of the court. It argued that federal law blocks the state claims at issue. The companies said Boulder’s theory reaches conduct and emissions that occurred outside Colorado. Their argument focused on federal control over interstate emissions.

    Boulder’s lawyers said states may provide remedies for injuries that occur within their borders. They argued that the lawsuit does not simply regulate emissions. The complaint also includes allegations about marketing, concealment and other conduct involving fossil fuel products. Boulder said the Clean Air Act does not erase those state remedies. The justices questioned both sides about preemption, state authority and jurisdiction. The exchange also covered earlier Supreme Court decisions involving interstate pollution.

    Eight justices weigh the case

    Justice Samuel Alito did not participate, leaving eight justices to hear the case. The official transcript shows extensive questioning on jurisdiction before the merits discussion developed. The justices also examined the Clean Air Act and the balance of power between state and federal law. They issued no ruling from the bench. The Supreme Court has not announced a decision date. The Colorado judgment remains the ruling under review while the federal case continues.

    The Supreme Court is deciding whether federal law prevents Boulder from pursuing these state claims. It is not deciding whether ExxonMobil or Suncor Energy owes climate damages. Similar lawsuits from state and local governments remain active elsewhere in the United States. This case focuses on federal preemption and the Court’s power to review the dispute. The underlying allegations remain unresolved. Any final ruling will address the legal questions presented in this case.
